An important win in the United States Supreme Court
In the case of Gonzales v. Oregon, 546 U.S. 243, 126 S. Ct. 904, 163 L. Ed. 2d 748 (2006), Eli Stutsman sued former Attorney General John Ashcroft and the Drug Enforcement Administration (DEA) in federal District Court on behalf of his clients, a physician and a pharmacist who were threatened by DEA lawyers and drug diversion investigators with criminal investigations, prosecutions, fines, and imprisonment.
Attorney General Ashcroft lost at all three levels – in the Federal District Court (or trial court), in the Ninth Circuit Court of Appeals, and before the United States Supreme Court. This case is further remarkable because the Federal Courts at all three levels enjoined the United States Attorney General and the DEA’s attorneys and field agents from investigating and prosecuting Oregon physicians and pharmacists practicing in accord with the Oregon Death with Dignity Act. A rare victory and a very satisfying win for any appellate lawyer.
